US Congress

The Senate Committee on Commerce, Science, and Transportation announced it will convene a full committee hearing titled “Examining the Multistakeholder Plan for Transitioning the Internet Assigned Number Authority” on May 24, 2016.  The hearing will examine the proposed transition of oversight of the Internet Assigned Numbers Authority (IANA) (a department of the Internet Corporation for Assigned Names and Numbers (ICANN)) that allocates Internet IP addresses and domain names0 to the global multistakeholder community.  Two years ago, the National Telecommunications and Information Administration (NTIA) announced its intention to transition IANA functions.  In March 2016, ICANN forwarded a transition proposal to the NTIA.  The proposal was developed by the international community of Internet stakeholders.  The NTIA set a target of 90 days to complete its review of the proposal. 

 

FCC

          DOJ Access to Confidential Data

The FCC announced that the Department of Justice (DOJ) has requested access to the confidential and highly confidential information submitted in its Special Access Data Collection (nka Business Data Service) proceeding and its proceeding considering the proposed acquisition by Verizon Communications Inc. of XO Communications, LLC.  The DOJ wants the information for use in its own investigation of the Verizon/XO transaction.  The DOJ described its plans to protect the confidentiality of the sensitive information it obtains and prevent competitively sensitive information from being shared among competitors.  Affected parties have until May 28, 2016, to oppose the DOJ’s request for access to confidential and highly confidential information.

 

          SADC (aka Business Data Services Data Collection)

The FCC released another list of additional parties that have signed an acknowledgement of confidentiality (AOC) and that seek to review the data gathered through the FCC’s special access data collection (SADC).  The list includes persons that signed an AOC since the FCC’s last Public Notice.  Companies that submitted confidential or highly confidential information in response to the SADC have until May 25, 2016, to object to the disclosure of their data and information to any of the parties on the list.

 

New York

Pending legislation (SB 7813) would change the composition of the Public Service Commission from five commissioners to 11 commissioners.  The commission would consist of 11 members, nine voting (appointed by the governor, the speaker of the assembly, and the temporary president of the senate) and two non-voting (appointed by the minority leader of the assembly and the minority leader of the senate).  The proposed legislation would also clarify the mandatory time frame within which the PSC must act upon petitions, i.e., within 90 days of the filing of the petition or if the petition alleges an emergency or some other action that threatens or impacts the health or safety of any person, as soon as possible or no more than 30 days.
